CyberArk Software Earnings Are Imminent; These Most Accurate Analysts Revise Forecasts Ahead Of Earnings Call

The Federal Trade Commission has accused Amazon.com Inc. (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/AMZN#NASDAQ">AMZN</a>) of concealing key evidence in the antitrust case that claims the <a href="https://www.benzinga.com/government/regulations/25/01/42822625/big-techs-date-with-antitrust-alphabet-meta-amazon-brace-for-legal-showdowns-in-2025">retail giant abused its market power</a>. As per a new court filing, the FTC says Amazon withheld thousands of non-privileged documents by incorrectly labeling them as protected.
What Happened: Following an order by a federal judge to re-review its privilege claims, Amazon withdrew 92% of them and presented around 70,000 documents it had withheld earlier, according <a href="https://www.courthousenews.com/ftc-accuses-amazon-of-hiding-evidence-in-antitrust-case/">to</a> the Courthouse News Service. 
The FTC discovered that around 75% of those had been completely shielded from view. In a small in-camera review, a single sentence out of nine documents was deemed privileged. 
One document quoted a top executive calling founder and former CEO Jeff Bezos Amazon's "chief dark arts officer" when describing the "shady world" of tactics employed to boost Prime subscriptions, the report noted.

Why It Matters: The FTC says these documents were withheld not because they were legally protected, but because they &nbsp;damaging evidence. "In essence, Amazon's privilege log — on which the FTC has relied throughout discovery — was almost entirely wrong," the commission wrote in its motion. "It is impossible to square a 92% error rate across tens of thousands of documents with a mere mistake."
The commission also said that Amazon has a pattern of falsely labeling routine communications as "privileged" and alleged that the company instructs staff to mislabel documents to sidestep regulatory scrutiny. "The blatant nature and ubiquity of these actions demonstrate&#8230; a purposeful plan," the FTC added.
Calling the withheld records &#8220;probative, inculpatory, and entirely nonprivileged,&#8221; the FTC has asked the court for another 90 days of discovery and for Amazon to bear the resulting costs. Amazon denies any wrongdoing. "The FTC wants to distract from the facts," a spokesperson said in a statement.
Amazon is not the only tech giant locking horns with the FTC. Last month, hearings began as part of the FTC's <a href="https://www.benzinga.com/news/25/04/44888906/meta-faces-an-antitrust-lawsuit-ftc-says-company-holds-a-social-network-monopoly">antitrust lawsuit against Meta</a>.

Renowned independent investment strategist Ed Yardeni, the President of Yardeni Research, has lowered his U.S. recession probability while raising his S&amp;P 500 target following the trade deal with China.
What Happened: After the U.S. and China announced a <a href="https://www.benzinga.com/markets/equities/25/05/45341884/apple-amazon-nvidia-rise-in-monday-premarket-as-us-china-agree-to-90-day-tariff-truce-neither-side-wants-a-decoupling">90-day truce </a>on Monday, the markets cheered the development as the S&amp;P 500 and Nasdaq 100 rallied over 3%.
While this provides a short-term relief, Yardeni noted in his QuickTakes that the negative wealth effect of President Donald Trump&#8217;s tariffs was &#8220;probably insignificant&#8221; after the announcement of the deal.
According to his earlier analysis, the tariff turmoil was having a &#8220;negative wealth effect on consumers, especially retired and soon-to-be retiring Baby Boomers, who collectively own about $25 trillion in corporate equities and mutual funds.&#8221;
This led him to raise the &#8220;subjective probability of a recession&#8221; this year from 20% to 35% on March 5, and from 35% to 45% on March 31 as stock prices tanked in response to the tariffs.
However, he said that &#8220;We didn&#8217;t cross over to the dark side subsequently, i.e., forecasting greater than a 50% chance of a recession. Instead, we lowered our recession odds back down to 35% on May 4. Now we are lowering it again to 25%.&#8221;
After Monday&#8217;s stock market rally, he also raised the S&amp;P 500 year-end target back up to 6,500 from 6,000.

Why It Matters: Concerning other metrics, Yardeni highlighted that he has raised the real GDP growth range to 1.5%-2.5% this year, up from our previous 0.5%-1.5%.
Also, he predicts the S&amp;P 500 forward earnings to rise to $300 per share at the end of this year.
&#8220;We now see the S&amp;P 500 forward P/E at 21.6 at the end of the year rather than 20.0 as we previously had projected,&#8221; he said.
Price Action: The SPDR S&amp;P 500 ETF Trust (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/SPY#NYSE">SPY</a>) and Invesco QQQ Trust ETF (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/QQQ#NASDAQ">QQQ</a>), which track the S&amp;P 500 index and Nasdaq 100 index, respectively, jumped with joy on Monday. (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/RGTI#NASDAQ">RGTI</a>), which announced its <a href="https://benzinga.com/news/earnings/25/05/45360620/rigetti-stock-sinks-after-q1-revenues-miss-estimates-details">first quarter results</a> on Monday, posting a 51.77% year-over-year decline in revenues. &#8220;This is the real state of affairs in quantum compute,&#8221; he says, &#8220;nothing is happening.&#8221;
In the same post, he attacked others such as IONQ Inc. (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/IONQ#NYSE">IONQ</a>), which he says is &#8220;making up&#8221; revenues via &#8220;desperate acquisitions. Followed by D-Wave Quantum Inc. Why It Matters:&nbsp;Saylor&#8217;s company Strategy, formerly MicroStrategy, has been heavily investing in Bitcoin. The firm reported acquiring <a href="https://www.benzinga.com/markets/cryptocurrency/25/05/45349057/strategy-buys-134b-in-bitcoin-at-99856-cites-155-btc-yield">13,390 BTC for approximately $1.34 billion at an average price of $99,856</a> per coin on Monday, pushing their total Bitcoin holdings to 568,840 BTC, accumulated at a combined cost of $39.41 billion and an average purchase price of $69,287.
Notably, the Bitcoin treasury company <a href="https://www.benzinga.com/25/04/44704504/michael-saylor-still-trusts-bitcoins-long-term-potential-even-as-strategy-risks-going-into-losses-on-btc-buys">came close to experiencing an unrealized loss</a> on its investments last month after the apex cryptocurrency slipped below $75,000 following President Donald Trump&#8217;s sweeping tariff announcement.
Schiff, a fierce critic of all things Bitcoin, has <a href="https://www.benzinga.com/24/11/42237876/peter-schiff-predicts-microstrategys-bankruptcy-due-to-bitcoin-investment-strategy">consistently questioned Strategy&#8217;s Bitcoin playbook</a>, arguing that its commitment to repay a large sum of money to <a href="https://www.benzinga.com/markets/equities/24/11/42186167/michael-saylors-microstrategy-convertible-notes-to-buy-bitcoin-offer-no-interest-so-why-are-investors-rushing-to-buy-them" target="_blank" rel="noreferrer noopener">debt holders</a>&nbsp;could be at risk if the leading cryptocurrency falls sharply.
