NRG Energy, Inc. (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/NRG#NYSE">NRG</a>) reported better-than-expected first-quarter financial results. Shares of Kindly MD, Inc. (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/KDLY#NASDAQ">KDLY</a>) jumped 251% on Monday after the company announced a merger agreement with Nakamoto Holdings to start a Bitcoin treasury strategy.
On the economic data front, the U.S. government recorded a $258 billion budget surplus in April, up 23% year-over-year.

The Federal Trade Commission has accused Amazon.com Inc. (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/AMZN#NASDAQ">AMZN</a>) of concealing key evidence in the antitrust case that claims the <a href="https://www.benzinga.com/government/regulations/25/01/42822625/big-techs-date-with-antitrust-alphabet-meta-amazon-brace-for-legal-showdowns-in-2025">retail giant abused its market power</a>. As per a new court filing, the FTC says Amazon withheld thousands of non-privileged documents by incorrectly labeling them as protected.
What Happened: Following an order by a federal judge to re-review its privilege claims, Amazon withdrew 92% of them and presented around 70,000 documents it had withheld earlier, according <a href="https://www.courthousenews.com/ftc-accuses-amazon-of-hiding-evidence-in-antitrust-case/">to</a> the Courthouse News Service. 
The FTC discovered that around 75% of those had been completely shielded from view. In a small in-camera review, a single sentence out of nine documents was deemed privileged. 
One document quoted a top executive calling founder and former CEO Jeff Bezos Amazon's "chief dark arts officer" when describing the "shady world" of tactics employed to boost Prime subscriptions, the report noted.

Why It Matters: The FTC says these documents were withheld not because they were legally protected, but because they &nbsp;damaging evidence. "In essence, Amazon's privilege log — on which the FTC has relied throughout discovery — was almost entirely wrong," the commission wrote in its motion. "It is impossible to square a 92% error rate across tens of thousands of documents with a mere mistake."
The commission also said that Amazon has a pattern of falsely labeling routine communications as "privileged" and alleged that the company instructs staff to mislabel documents to sidestep regulatory scrutiny. "The blatant nature and ubiquity of these actions demonstrate&#8230; a purposeful plan," the FTC added.
Calling the withheld records &#8220;probative, inculpatory, and entirely nonprivileged,&#8221; the FTC has asked the court for another 90 days of discovery and for Amazon to bear the resulting costs. Amazon denies any wrongdoing. "The FTC wants to distract from the facts," a spokesperson said in a statement.
Amazon is not the only tech giant locking horns with the FTC. Last month, hearings began as part of the FTC's <a href="https://www.benzinga.com/news/25/04/44888906/meta-faces-an-antitrust-lawsuit-ftc-says-company-holds-a-social-network-monopoly">antitrust lawsuit against Meta</a>.

While this provides a short-term relief, Yardeni noted in his QuickTakes that the negative wealth effect of President Donald Trump&#8217;s tariffs was &#8220;probably insignificant&#8221; after the announcement of the deal.
According to his earlier analysis, the tariff turmoil was having a &#8220;negative wealth effect on consumers, especially retired and soon-to-be retiring Baby Boomers, who collectively own about $25 trillion in corporate equities and mutual funds.&#8221;

Price Action: The SPDR S&amp;P 500 ETF Trust (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/SPY#NYSE">SPY</a>) and Invesco QQQ Trust ETF (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/QQQ#NASDAQ">QQQ</a>), which track the S&amp;P 500 index and Nasdaq 100 index, respectively, jumped with joy on Monday. The SPY was up 3.30% to $582.99, while the QQQ advanced 4.07% to $507.85, according to <a href="https://pro.benzinga.com/dashboard">Benzinga Pro</a> data.

After Monday, all the indices were out of the correction zone. The S&amp;P 500 index was down 4.93% from its record high of 6,147.43 points, scaled on Feb. 19. Dow Jones was 5.91% lower than its 52-week high of 45,073.63 points, and Nasdaq 100 was 6.09% lower than its previous high of 22,222.61 points.
On Tuesday, the futures of the Dow Jones, S&amp;P 500, and Nasdaq 100 indices were trading lower.

Reported Earlier, First Industrial Realty Trust Prices $450M Of 5.25% Senior Notes Due 2031

Landsea Homes (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/LSEA#NASDAQ">LSEA</a>) reported quarterly losses of $(0.05) per share which beat the analyst consensus estimate of $(0.09) by 44.44 percent. This is a 183.33 percent decrease over earnings of $0.06 per share from the same period last year. The company reported quarterly sales of $310.81 million which missed the analyst consensus estimate of $312.00 million by 0.38 percent. This is a 5.70 percent increase over sales of $294.04 million the same period last year.
