A federal court has sided with the U.S. Department of Health and Human Services (HHS), rejecting Johnson &amp; Johnson&#8217;s (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/JNJ#NYSE">JNJ</a>) effort to reshape its participation in the <a target="_blank" href="https://www.benzinga.com/general/health-care" rel="noreferrer noopener">340B Drug Pricing Program</a>.
The ruling comes after months of legal back-and-forth following Johnson &amp; Johnson's proposal to shift from upfront drug discounts to a rebate model—an approach the <a target="_blank" href="https://www.benzinga.com/general/biotech/24/08/40560227/johnson-johnson-aims-new-policy-for-hospital-payments-under-340b-drug-discount-program-related-to" rel="noreferrer noopener">agency never formally approved</a>.
The dispute centers on the 340B Program, a federal initiative requiring pharmaceutical manufacturers that participate in Medicaid and Medicare Part B to sell outpatient drugs at reduced prices to certain healthcare providers, including hospitals and clinics that serve low-income and rural populations.

Johnson &amp; Johnson, a long-time participant in the program, initiated litigation in November 2024 after the Health Resources and Services Administration (HRSA) declined to approve its proposed rebate structure.
Under Johnson &amp; Johnson&#8217;s plan, covered entities would pay the full list price for certain drugs and receive rebates later.
The company contacted HRSA in June 2024 to outline the plan, but the agency made clear it had not given the green light.
Despite this, Johnson &amp; Johnson <a target="_blank" href="https://www.benzinga.com/general/biotech/24/11/41941391/johnson-johnson-challenges-government-drug-pricing-dispute-over-two-drugs" rel="noreferrer noopener">proceeded to file suit</a> against HHS, HRSA, and their respective leadership, arguing that HRSA's rejection was arbitrary under the Administrative Procedure Act (APA).
In January 2025, UMass Memorial Medical Center, Genesis HealthCare System, and the advocacy group 340B Health were granted permission to intervene in the case as defendants, <a target="_blank" href="https://sponsors.aha.org/rs/710-ZLL-651/images/20250627_340B_045111473084.pdf?version=0" rel="noreferrer noopener">arguing</a> the rebate model would undercut the purpose of the 340B program and impose financial strain on safety-net providers.
Johnson &amp; Johnson subsequently moved for summary judgment on its single APA claim, while both the federal agencies and the intervenors filed cross-motions. The court has now denied Johnson &amp; Johnson's motion and ruled in favor of HHS and the intervenors, concluding that the agency acted within its authority and did not violate administrative law in rejecting the rebate plan.
The decision marks a significant win for hospitals and healthcare groups reliant on upfront 340B pricing to manage drug costs, especially for vulnerable patient populations. It also affirms HRSA's oversight authority in maintaining the integrity of the 340B program.
In sum, based on the plain and unambiguous language of the 340B statute, and supported by its purpose and history, HRSA has the authority to "provide" for discounts, rebates, or both. This conclusion defeats J&amp;J's claim that HRSA lacked the authority to require prior approval of J&amp;J's rebate model, the lawsuit alleged.
Price Action: JNJ stock is up 0.10% at $152.91 during the premarket session at the last check on Tuesday.

Johnson & Johnson's Drug Discount Plan Gets Thrown Out In Court

The U.S. Food and Drug Administration (FDA) announced on Friday that it has eliminated the Risk Evaluation and Mitigation Strategies (REMS) for currently approved BCMA- and CD19-directed autologous chimeric antigen receptor <a target="_blank" href="https://www.benzinga.com/general/health-care" rel="noreferrer noopener">CAR T cell immunotherapies</a>.&nbsp;
These products are gene therapies currently approved to treat blood cancers, such as multiple myeloma and certain types of leukemia and lymphoma.
&#8220;The FDA has taken the bold step to remove the Risk Evaluation and Mitigation Strategy requirement from giving CAR T therapies. REMS is a useful safety system, but reevaluation over time helps inform whether a REMS is still needed to ensure that the benefits of a product outweigh its risks,&#8221;&nbsp;said FDA Vinay Prasad, Chief Medical and Scientific Officer and Director, Center for Biologics Evaluation and Research.&nbsp;

&#8220;Eliminating the REMS that is no longer needed also expedites the delivery of potentially curative treatments to patients and reduces the burden on providers,&#8221; he added.
A REMS is a safety <a target="_blank" href="https://www.fda.gov/news-events/press-announcements/fda-eliminates-risk-evaluation-and-mitigation-strategies-rems-autologous-chimeric-antigen-receptor" rel="noreferrer noopener">program</a> that the FDA can require for certain medications with serious safety concerns to help ensure the benefits of the medication outweigh its risks.
The FDA determined that the approved REMS for the f<a target="_blank" href="https://www.benzinga.com/general/biotech/24/01/36760938/gileads-tecartus-dropped-from-fda-list-of-car-t-therapy-with-updated-label-warning-of-risks-of-se" rel="noreferrer noopener">ollowing products should be eliminated</a> because a REMS is no longer necessary to ensure that the benefits of the autologous CAR T cell immunotherapies outweigh their risks.&nbsp;
The products affected by this change include Bristol Myers Squibb &amp; Co.&#8217;s (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/BMY#NYSE">BMY</a>) Breyanzi (lisocabtagene maraleucel) and Abecma (idecabtagene vicleucel), Johnson &amp; Johnson&#8217;s (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/JNJ#NYSE">JNJ</a>) Carvykti (ciltacabtagene autoleucel), Novartis AG&#8217;s (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/NVS#NYSE">NVS</a>) Kymriah (tisagenlecleucel), and Gilead Science Inc.&#8217;s (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/GILD#NASDAQ">GILD</a>) Yescarta (axicabtagene ciloleucel) and Tecartus (brexucabtagene autoleucel).
The elimination of REMS for the above products removes the requirements that hospitals and their associated clinics that dispense products must be specially certified and have on-site, immediate access to tocilizumab.
&#8220;Continuous monitoring and assessment of the safety of all biological products, including the CAR T cell immunotherapies, is an FDA priority and we remain committed to informing the public when we learn new information about these products,&#8221; the FDA said in a press release.
As per a <a target="_blank" href="https://www.fda.gov/vaccines-blood-biologics/safety-availability-biologics/fda-eliminates-risk-evaluation-and-mitigation-strategies-rems-autologous-chimeric-antigen-receptor" rel="noreferrer noopener">safety</a> statement on Thursday, the regulator also reduced its requirement that patients remain near the facility where they received treatment to two weeks. The agency also removed its advice to patients to avoid driving for two weeks following product administration.
Commenting on the development and accessibility of CAR T-cell therapies, William Blair said, &#8220;Overall, we view the removal of the REMS program for CAR-T cell therapies as a positive development for the space, as it supports the notion that the FDA is working to minimize red tape and increase access to potentially curative treatments for patients. We also believe the removal of the REMS requirements could increase access and use of these therapies in the community settings.&#8221;
Analyst Sami Corwin said the update also suggests there will likely be no REMS requirements for CD19 and BCMA autologous CAR-T cell therapies approved in the future, such as Arcellx, Inc&#8217;s (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/ACLX#NASDAQ">ACLX</a>) anito-cel.
Moreover, Corwin highlighted the positive implications for companies developing CAR T-cell therapies for autoimmune diseases, such as Autolus Therapeutics plc (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/AUTL#NASDAQ">AUTL</a>), Bristol-Myers, and Cabaletta Bio, Inc (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/CABA#NASDAQ">CABA</a>), &#8220;given that the safety profile is more tolerable than in oncology.&#8221;

These data, featured at the European Academy of Neurology (EAN) 2025 Congress in Helsinki, Finland, are among the 11 abstracts Johnson &amp; Johnson&nbsp;is presenting.

Based on the ITC, which included the pivotal Phase 3 Vivacity-MG3 study data, IMAAVY showed comparable onset of symptom relief at Week 1 and showed consistent and sustained disease control with greater or statistically significant improvement of MG-ADLa scores versus the published Phase 3 data of other marketed FcRn blockers at several timepoints up to 24 weeksb of treatment.1 Results were consistent across multiple ITC methodsc.

<li>Population-adjusted&nbsp;ITCs without a common control exhibited significantly greater mean improvements in MG-ADL scores favoring IMAAVY over other FcRn blockers, at Weeks 8-24d versus one comparator and at Weeks 10-14d versus another comparator.1</li>

Donald Trump Jr. has joined billionaire entrepreneur Mark Cuban in publicly voicing disapproval of Sen. Elizabeth Warren (D-Mass.)&#8217;s approach to healthcare pricing.
Despite their political differences, Trump Jr. and Cuban found a common point of contention in Warren&#8217;s healthcare pricing strategy. They criticized the senator for not addressing&nbsp;the role of pharmacy benefit&nbsp;managers (PBMs) in escalating drug costs.
Warren had previously argued&nbsp;that the tax system was&nbsp;&#8220;rigged&#8221;&nbsp;because large pharmaceutical companies like&nbsp;Johnson &amp; Johnson&nbsp;(NYSE:<a class="ticker" href="https://www.benzinga.com/stock/JNJ#NYSE">JNJ</a>) often escape federal taxes while charging exorbitant prices for their drugs. 
She wrote on X saying that the "highest drug prices in the WORLD while often paying ZERO dollars in federal taxes themselves."
